1. What MailMan Does
MailMan is a document mailing service operated by Lexopoly Inc. ("we," "us," "our"). You upload a PDF, provide a recipient address, and pay for postage. We print and submit your document to the United States Postal Service (USPS) or an equivalent postal carrier for delivery.
2. Service Commitment & Pricing
We will submit your document to the postal carrier within 24 hours of confirmed payment. "Confirmed payment" means we have received successful payment confirmation from our payment processor.
Pricing is displayed at the time of checkout. We reserve the right to change pricing at any time; however, the price confirmed at checkout is the price you pay for that mailing.
3. Delivery & Tracking
Once we submit your document to the postal carrier (USPS), delivery is handled by that carrier. We do not guarantee delivery timing or that your document will be read or acted upon by the recipient.
What we provide depends on your selected service tier:
- First Class Mail: Certificate of mailing (affidavit) as proof your document was submitted to the carrier. This is proof of mailing, not proof of delivery.
- Certified Mail: USPS tracking number with delivery status updates. When USPS confirms delivery, we provide a return receipt (green card) as proof of delivery.
- Priority Mail: USPS tracking number with delivery status updates and faster carrier handling.
Tracking information and delivery confirmation are provided by USPS. We relay this information as-is and are not responsible for USPS tracking accuracy or delays.
4. Your Responsibilities
- You are solely responsible for the content of documents you upload.
- You must provide accurate recipient addresses. We are not liable for undeliverable mail due to incorrect addresses.
- You must not use MailMan to send threatening, harassing, fraudulent, or illegal materials.
- We scan uploaded files for malware and reserve the right to reject any file flagged by our security systems.
5. API Access
We provide an application programming interface (API) for programmatic access to MailMan. API keys are issued per-account and authenticate requests on your behalf.
- You are responsible for keeping your API keys confidential. Any activity under your key is your responsibility.
- We may rate-limit or suspend API access at our discretion to protect service availability.
- Automated use of MailMan via the API is subject to the same content and conduct rules as manual use.
- We may revoke API keys at any time for violations of these Terms.
6. Account Suspension & Termination
We may suspend or terminate your account, with or without notice, if we reasonably believe you have violated these Terms, used MailMan for illegal purposes, or engaged in activity that threatens the security or integrity of our service. Upon termination, pending unpaid mailings will be cancelled. We are not obligated to deliver mailings associated with a terminated account.
7. Refunds & Cancellations
- Before printing: You may cancel a mailing and receive a full refund.
- After printing or mailing: No refunds are available, as we have already incurred fulfillment costs.
- Service failure: If we are unable to submit your document to the postal carrier due to an error on our end, you will receive a full refund.
Refunds are issued to the original payment method within 5–10 business days.
8. As-Is Service
MailMan is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
9. Limitation of Liability
To the maximum extent permitted by law, our total liability for any claim arising from your use of MailMan is limited to the amount you paid for the specific mailing at issue. We are not liable for indirect, incidental, special, consequential, or punitive damages.
10. Third-Party Services
We use third-party service providers for payment processing, postal fulfillment, and other operational functions. Your use of MailMan is also subject to the terms and policies of these providers. We are not responsible for the acts or omissions of third-party service providers.
11. Dispute Resolution
Any dispute arising from or relating to these Terms or your use of MailMan shall be resolved by binding arbitration administered under the rules of the American Arbitration Association, conducted in Wilmington, Delaware. You agree to arbitrate on an individual basis only — class actions and class arbitrations are not permitted.
12. Governing Law
These Terms are governed by the laws of the State of Delaware, without regard to conflict of law principles.
13. Changes
We may update these Terms from time to time. Continued use of MailMan after changes constitutes acceptance of the updated Terms.
